Thing is though: a DM is an assistant who may only assist under the direct supervision of a qualified (and thus insured) Instructor. So are they really "in control" or "responsible". (DM-led courses excluded of course)

I could be wrong, but I understood it to be the case that PADI International have definitively said that qualified DMs are indeed "divers at work". That's what my CD told me anyway.
Anyway, you'd have to be some sort of madman not to make sure that you're demonstrably "fit" enough to be involved in a diving operation involving members of the public.
