Wink Umm

I think Andy might know what he's talking about & that the police have been involved

He let me (& a few more) know a week or so ago that the unit was stolen and we've kept quiet in the hope that the police can catch the thief

And FWIW, Andy is the UK's importer for Subs...

Actually our boot sale had someone with a load of diving gear last summer ,cylinders, regs the lot & before anyone asks yes it was kosher .

Personally if i was to buy this unit ,obtain a receipt & then the manufacturer said "sorry we are not supporting this unit because it was stolen even though we know you didn't steal it " then I would not be happy with the manufacturer & would be shouting it from the highest place possible .This unit could have been through many ligitimate hands since it was stolen .If Andy is saying that the guy selling it is also the guy that stole it then that makes it slightly different but not from the point of view of the buyer .

Not really. As with all stolen goods, the property is returned to the original owner and the buyer, even if it were bought in ignorance, gets nothing. Better this bought at a car boot than with cars which is probably the most common place to get caught out.

Hence "caveat emptor"...

Lou
If he bought it & got a receipt (unlikely at a boot sale) then unless the law has changed in the last year it is his end of .I bought a lorry from a main dealer that turned out to be stolen ,when the police caught up to me they checked I had a receipt & had bought it in good faith & that was the end of it .The original owner tried to reclaim it but had no legal claim to it from me .ultimately the people who lost out was obviously the original owner & the auction house who had not checked enough & had to pay the original owner what they had sold it for .
If Andy is saying the guy selling it is also the thief then none of the above applys but if someone buys it from ebay then they have bought it in good faith & if Andy said later & could prove that he had complained to ebay & the police then ebay is technically the auction house & if they have not acted on information from Andy then I would like to think that they are liable .
But the biggest issue i have is if someone does buy it in good faith ,then Andy says it will not be supported ! Andy will have written the theft of against Tax etc plus hopefully been paid out by his insurance company so all that happens is he has one seriously p***ed of person who wants to use there scr who then sells it & the circle starts again .

Hmmm. that is very much not my understanding of it..

If someone gets stolen goods, even if they have paid a fair price and are unaware that the goods were stolen, the general rule is that the person with the goods does not usually get a legal right of ownership. The person with the goods must inform the owner and allow them to take them away, if they discover that they were stolen. Someone who buys goods, which they later find out were stolen, could try to claim compensation from the seller.
