Thats very true but if you were salvaging something for someone then you wouldn't be working as an instructor so I doubt that these rules would apply.

Not necessarily. Not everyone that you pay is an employee.

Such people can be a self-employed person, with whom you have a contract for services. It depends on a number of factors.

no doubt a serious subject, and one that some peeps are likely to get passionate about...

to me, its another case of taking things too far, no common sense being applied to the particular scenario...

i've bought instructors bottles before now if they've gone out of there way to help me complete training etc... i'd like to think that no court in the land would convict someone on the basis of receiving beer/gift etc on the basis of doing a favour...

imagine similar situation out of diving? e.g. you bring back beer/cigarettes for a friend who ran you/picked you up from airport - and he crashes car on way... how would that insurance stand if it's viewed he's done it for cash/reward...

i think (hope) common sense would differentiate a gift from payment...

anyway, more importantly i'm off to tenerife in 3 weeks.... ;o)

I'm relieved to see someone more pedantic than me!! You are correct.

However, you still have a duty of care to such a person. Furthermore if you are in the habit of paying them and misrepresent to them their status they can claim that they believed you were employing them and as such are responsible for their PAYE and NI deductions.

The weasely shits that are Insurance companies will no doubt find some reason to avoid payment if such an individual is on your premises.

10 years ago this would have been funny. In our "sue everyone just like the yanks do" climate its scary.........

Unless your friend's insurance covered hire and reward s/he is in the shit.

It is also illegal to import into the UK duty-free alcohol or tobacco unless for PERSONAL consumption.

Common sense????????????????????????? Haaaaaaaaaaaa... The Customs & Excise??????????

"Common sense is the set of prejudices a man acquires by the time he is 21" Albert Einstein.

Enjoy Tenerife - hope you get to see whales and stuff. Great place.

I know...! 3rd time in 12 months... :o)

Even saw atlantic dolphins last time on the whale trip...

As long as SCUBA1 keeps the Mako's away, and no one here's me screaming at the Sting Rays again, it'll be great...!

Question for Andy

Andy, just how much does an HSE part 1, 2 or 3 (whatever) cost these days? And how long does it take to complete? Just out of interest of course.

2K now that sounds sore. That would require a regular stream of requests for "favors" to make it worth the hassle. Until then I’ll stick with what Cat woman says “when I’m good I’m very good but when I’m bad I’m better” or some shite like that. Not that I’m ever bad you understand
