Talking I have trounced the bank!

Just had to share this - I took the bank to court over the bank charges and my case was heard at 12:00hrs today. They didn't turn up, depsite lodging a 1½ page defence, the sheriff was not pleased and she announed a decree and expenses to me! One happy happy Frog, and I go on holiday tomorrow. Champagne tonight, I have stuffed the bank, la la la la la.

Frog,

You do realise that your bank is perfectly within their rights to close all of your accounts and demand any monies oweing from you.

I guess you knew that though (and probably moved bank already) - otherwise you wouldn't have done it.

Great news. They never turn up because it's too expensive for them to defend and they know they will lose so that drag it out to the last minute in case you lose your bottle.

Talking Happy Frog

Still on the ceiling about this! The worst bit was when I stood in front of the sheriff and my stomach rumbed all through her talking. Loudly rumbled! The money will go towards my new tattoo which is going to be started on 11th August! So I will have the charges, with interest, loss of earnings and expenses.

They've done this before and then not turned up to the hearing. They do everything they can to stall. If you turned up as well and argued that they don't need an adjournment because this isn't a unique case, it's much publicised, they've had plenty of time to sort their defence out etc etc and that you are ready to proceed the judge will normally proceed and reject their appeal for adjourment.

I hear a lot about people reclaiming bank charges but I've never been able to work out how come the amounts are so high! Not having a go but I don't think I've ever piad more than £50 of bank charges in total! Is anyone prepared to share that information with me? I am genuinely interested. If it helps as a comparison, I am 30, went to university and have a mortgage.

Many Thanks,
Nic

Don't wrestle with a pig. You'll only get as dirty as the pig & the pig likes it

The initial claims are usually low. You can claim back as far as 6 years. My claim was initially for about £400 (less than £80 a year) but because Abbey didn't pay and I went to court they got hit by 8% statutory interest dating back to when the charge was incurred plus my court costs.
