Does anyone understand insurance claims

Last year someone crashed into the back of my car while I was waiting at a set of traffic lights. Recently my solicitors wrote to me with a copy of the medical report. All good, until the solicitor started to mention about P36 an option for the third party to settle the claim now if I was interested. In a nutshell my solicitor came up with a figure " which is crap" they settle at that amount and no more said. Problem is Im still going to the physcio and will be for the next few months. My solicitor has told me not to expect a better offer than what she is recommending ? Should I take her advice or just hold out and see what the third party offer

i can only pass on my experiences.
the value of damages to property and any loss of earnings is usually not the issue.
personnel injury is often the part contested.
if you cannot agree a figure then the 2 parties will have to go to court for the matter to be settled by a judge.
if the judge agrees a higher figure than has been offered to you then good.
if the figure is less then you may have also to pay the court costs.
very often the other party will make an increased offer just prior to walking into court.

your solicitor/barrister should give you advice on this.

Unless the third party is so arrogant that they think their initial offer will be sufficient! Still the mere threat of court should be enough to make them take notice.

On the other hand, I know most genuine people will hate these, but have you tried contacting any of these "no win no fee" people! may be worth a call!

I got hit about 4 years ago and wasn't hurt at all but still had to see a specialist doctor 3 months afterwards which was a waste of time

Got £1300 for my non existant injuries which also covered them for not making a claim in the future !!!

If you are hurt then be very careful as it may turn into a long term injury and once you settle you could be stuffed in the long term.

Just to add as I had legal insurance cover through my car insurance they claimed on my behalf, no court date or anything !!!

my claim was settled under the proviso that if my medical situation changed in the future because of the accident then i could return to court for a further settlement.

nothing has changed tho-i am still blind in my left eye.

I've got a slipped disk in the neck, at the moment and go to physcio every two weeks. The deal is, if I agree to settlement, then I can not make any new claims later should I not fully recover by Nov. I cant see the point in
accepting settlement now and also the amount that my solicitor has suggested. I've spoken to other people who have been in accidents and had no injuries. They offered me 2k ??

Suggest you get a 2nd opinon from a qualified source. 2k seems a tad small if the slipped disc has a marked effect on your quality of life later.

Strange that your existing solicitor reckons you should settle. I hope a qualified yder can offer some decent advice. This is no time for the unqualified mob to rear their barrack room heads.
