HR question - returning after maternity leave

SWMBO has just returned to work after 10 months maternity leave, but her dept head is being a pain in the bum and not letting her work from home under the flexible working arrangements. She has spoken to the union and has been told that she will get it, and her boss will probably give in just as they are about to walk into the tribunal (she's done it before). Hassle you don't need on your return to work.
But the week before last an old boss of her's e-mailed her saying I've got a job you maybe interested in. She went for an interview Wednesday and had a call today telling her the job's her's. More money and at least 1 day working at home result!

Now to my point.
Her present company have a policy that you must work at least 3 months on return from maternity or pay back you maternity pay. Now SWMBO's notice period is also 3 months can these run concurrently?

yes the 3 months can be for both items there is no difference.
