    Tenants - deposit protection scheme

    My son and his girlfriend have just left their flat and there is a dispute with the landlady regarding returning the deposit i.e she won't.
    l went around there yesterday to try to mediate and come to an agreement and realised that she wasn't prepared to release any of the money.

    We now realise that they should have insisted, as is the law, that the deposit was registered with one of the deposit protection scheme, now my question is - am l right in thinking that the fine for not registering with a deposit protection scheme is 3 x the deposit? if so how do we go about getting it?

    It turns out that she has illegally converted the house to three flats and has broken a few fire safety regulations, she also hasn't notified the council and is not paying enough council tax and she didn't get planning permission for a change of use, so she' in big sh*te, but my son still wants his dosh.

    Oh and please no responses from the CDG saying go look for yourself.

    Done mate, if the Landlady hasn't put it in the scheme then AIUI she is personally liable for the money [this is what my letting agent told me] also I think it's illegal not to nowadays.

    I would think it would have to go through the small claims court though Might be worth contacting Woz to see if his solicitor will fire off a letter for your boy.

    If you look on the DirectGov site it says you have to apply to the county court, who will then order her to pay 3 times the deposit if she has not protected it.

    The C.A.B. is your friend, as is trading standards ...TS would be my first call, they will rip her a new one, then the council re not conforming to fire regs etc... as you say...she is deep in the do do!

    And I bet when Oct 1st comes she doesn't get an Energy Performance Certificate either

    Why don't you suggest to her that you are aware of her various breaches and that if she doesn't hand the dosh back then a letter to the appropriate authorities will be forthcoming?

    Make sure you smile whilst saying it though, else it could be construed as demanding money with menaces!

    councils don't deal with fire safety anymore.

    the local fire and rescue service do.

    Oh and they don't take things like that lightly either. An Audit under The Regulatory Reform (Fire Safety) Order 2005 will take place and that starts a sh*tstorm that you really wish never started as the inspecting officers are very thorough as the manager of the Lodmoor in weymouth found out in July.
