The stuff about RIPA is a bit off the mark - it only applies to public bodies so in fact they don't have to comply with it. You'd have done better down the line of the Human Rights Act.

Good effort otherwise. The DPA thing is brilliant - they have to do it or break the law. Nice to get them jumping through hoops! I think you should expect a reply on that within 14 days.

I Could be wrong, but I read the act from start to finish tonight and that was my understanding that RIPA and indeed the Police and Criminal Evidence Act and the Codes of practice apply to any body collecting information which can be used in court proceedings. I think this extends in some circumstances to the private security industry. (which these cowboys purport to be). It's there to protect the public from unauthorised collection of information, eg a private investigator tapping your phone. I do like the idea about human rights act though....Right to a private life....Will ammend my letter before I post it. Ta

Incidentally I believe they are misrepresenting themselves as members of the British Parking Association, but I'll follow that up tomorrow.

I will be writing to DVLA tomorrow to find out on what terms my details where disclosed to this company. I will also be speaking with the information commisioner to see if their use of my data breaches the guideleines.

I will also be complaining to the Security Industry Authority about their practices, but I expect I will find they are not licensed through the SIA. Our local Trading Standards have the company on record as a result of a number of complaints about their clamping operations. Obviously they no longer clamp as they now need a licence.

The more I dig the more I believe this is a scam.

Incidentally I went up to the market today and checked the scene against the photo. As far as I can see my car was not even on land 'patrolled' by them. It's my position that even if my car was trespassing on private land then they have a right to Sue me to recover any damages. They will need to prove firstly that I parked there (which I did not) and that I caused damage or inconvenience in some way. This is not possible as none of the business premises are open on a sunday.

Frankly I cant see any way they can win a a case against me. I dont think they will even try, but if they want to fair play to them. They can expect a fight. My next stage is to go to all the local papers.

They'll get so pi55ed off with me they will end up paying me to go away

As you can probably tell they have really got my back up!!

Luckily she was at work whenI got home so I had time to get angry with the company before she got back

The reason I'll take this as far as I possiblycan is to protect the vulnerable from such sharp practice as much as I can.
