They must have some kind of DPA or the DVLA are breaking the LAW

“A transfer of personal data to any other country is unlawful unless that country has an adequate lever of protection for such data”

For the DVLA to send any personal data this company would have to sign up to a thing called safe harbor.

Saying that the DVLA are still have responsibility over this data as they are the data controllers the third party are the data processors and again by law the DVLA are required to have a Data Protection clause within the contract. I still say you need to contact the DVLA to see how this company got your personal details. I think someone has f*****D up and if this is the case you could be eligible for compassion.

Why don’t you drop an email to the information commissioners office it’s not going to cost anything and if the office think you have a case they will take it up on your behalf

You just go to the Post Office pick up a form send it off with the right money and they will send you the details.

Not an expert but this guy (a policeman !) got of cause he knows the laws,

I belive the burden proof required in a civil case is less than that in a criminal case, but this guy clearly managed and the human rights laws say all persons must be treated equally.
Altenativly, park the car there again, when you get back point out that here's your money for parking, but you failed in your duty of care and there's a scratch on it so please can i have a new paint job.

Wouldnt work as they disclaim any responsibility for any damage howsoever caused. So by parking there you apparently agree to paying them £85 going up to £170 if you do not respond to their first notice which of course gets lost in the Post !! so now you have to pay £170 and going up... Can they take you to court if they do not own the Land ?

As i said..not an expert but NCP lost a case several years ago, the long and the short of it was some guys car was badly damaged whilst in their car park for which he had a valid ticket (a contract of offer and acceptance) NCP were told in court that they had to pay up as they had a duty of care ?
Disclaimers were of no value as apparantley in UK law you cannot absolve yourself of responsability, just mitigate it.
Most of these signs say fines for illegal parking, wheel clampping etc. That is not the same as no parking.
Next option would be just park there again and when some knobber comes out and takes a photo kick the shit out of him.

A slight deviation on the post...

As mentioned, a little different but kinda relevant...

I had an interesting one in Tescos car park, Bletchley recently. I parked up to go an do the weekly shopping and noticed this guy with an electronic pad noting my car details. I approached him and said "excuse me, but what are you doing?" to which he replied "I'm making a note of your car details" "Why?" "Company policy mate" "uh-huh... well, I'd rather you didn't" "Sorry guv, by parking here, you've agreed to have your details taken by <company name - not Tescos>" "So wait, by parking in the Tescos car park, to do my shopping at Tescos, I'm giving you <company name - not Tescos> permission to make notes about my car, registration plates etc.. etc?" "Yep" "Ummm... and what if I don't WANT you to?" "You've got to ring dat number guv" <chap indicates to tiny sign in carpark> "or not park in this here car park guv..."

At which point, the better half tugged me away saying "shopping is stressful enough without you moaning at the car park people..."

So apparently, either Tesco are keeping time on us parking or are formulating a master plan to take over the world and are tracking our every move...

Several supermarkets have a "park for so long for free" policy. The retail park in Tottenham has similar. Leave the car more than 3 hours and get clamped. Or something similar.

No doubt to pay off Shirley Porter's fines.....
