Cylinder

Were you at Capernwray yesterday and went home with an extra 12litre steel faber Cylinder

It's yellow, with black and white quarters, and a handle. It also has either my name (P. Brown) or my initials (PAB) on it in black marker pen.

I put it in for a fill at about 12:30 and that was the last I saw of it.

Hi Paul
Has it been taken in error ie mistaken identity and someone has left their one? Or has some scrote taken it? What has Capernwray staff said about this? Do they accept any responsibility?


I suggest that you put a notice on BSAC and any other dive forums. Hope you get it back.

I am assuming the best (It was v busy yesterday) and that it was taken in error.

I did a bit of ranting and raving at Chris (according to his card he is the director) and the staff an I did several laps of the car park looking. People doing shore cover from my club were also looking for it in the water.

On the Terms and conditions, there is a clause about not being responsible for cylinders left for a fill. I will speak to Trading Standards today to try and find out if this is potentially unenforcable. Chris's initial offer was a replacement at trade, but that is £123. I paid £108 for it last Jan from Kent Diving (delivered with a handle). I offered to meet him halfway and pay £60 but he wouldn't accept that. I thought it was a reasonable offer, especially as I would now have to explain where the big yellow thing has gone if I went home without it (luckily I seem to have done just about everything I could so SWMBO wasn't as mad about more 'wasted' money than she could have been - esp as we are going on holiday in 2 weeks and getiting a new bathroom, and some other decorating done which will also need to be paid for)

He said he would ring around the dive schools tomorrow and I agreed to get in touch with him on Weds to see if he had any success.

The bu**er is that the value of a new / replacement cylinder is below my insurance excess, and lower than court fees if I took it to small claims.

I would of thought that he would aceept my offer (at least out of goodwill); but there you go.

In the meantime, if anybody gained a cylinder yesterday, please let me know by PM

I have also posted this on the BSAC forum, Divernet and Conger Alley

you could have always waiting with it to be filled rather than leaving it unattended

I dont think you 'll get very far in the small claims court if theres a clause in the T&C

not for him it didn't, he loose £63 plus admit liability for you leaving your cylinder unattended

sounds more like he was doing you a favour offering you a new one at trade price and contacting clubs to see if anyone picked it up by mistake

you might also find unattended items fail to be payed out on your insurance

Gary,
I don't know if you've ever been to Capenwray but everyone leaves there kit for filling, so Paul was hardly being negligent and was following acccepted practice - might not be strictly correct to the letter of the law but a bit unfair to seemingly critize Paul for doing what everyone else does.

Yes mate, I realised that just seemed a bit harsh
So, No & everybody.
I like it a Capers but they are not the fastest sometimes and waiting around would clog up the shop and filling area, so in fact most folks are doing them a favour by not waiting around - I'm not making a judgements, I can understand all points of view but I have sympathy for Pauls plight.
