I reckon everyone has given the right answer here; A and B get an invite to dive off an already chartered boat, they shoot some vid and give a copy to the charterers - no probs - when all goes well. However, I wonder what action the HSE would take should there be an unfortunate incident? Would they round on the TV company and/or boat owner with intent to prosicute? It all suddenly becomes a grey area.

Aha, well, it might not be such a grey area anymore (for this thread anyway!)....Looks like the TV company have a "proper" diving contractor lined up . . . .

Good answer,the HSE will only get involved in the unfortunate case of an incident.
Then as Berko suggests if any sort of litigation were involved it could all start to get rather messy with the comeback probably in the direction of the production co.

You can supply some existing footage and get paid, no problem. You can take footage of an event while others are on site and sell you footage afterwards, no problem.

If you get asked to take footage of something, it becomes a problem. You can't be commissioned to do a job unless you have HSE Scuba.

I took footage & stills of the Dollar Cove stuff, BBC wanted it, so they paid me fot it.

Your local dive School are getting paid to provide the course presumably. Therefore you are at work and entitled to the full 'protection' of the HSE - whether you like it or not.
